1. INTRODUCTION & ACCEPTANCE

Welcome to Shawn Studioss. By hiring us, paying a booking fee, or signing a quotation, you (“The Client”) agree to be bound by the following Terms & Conditions. These terms constitute a legally binding agreement between The Client and Shawn Studioss (“The Company”) regarding the provision of photography, videography, décor, catering, and event planning services.

2. BOOKING & PAYMENTS

To secure a date and service, a non-refundable Booking Fee is required.

  • Booking Confirmation: Dates are only reserved upon receipt of the Booking Fee. Verbal confirmation or enquiries do not constitute a booking.

  • Payment Schedule:

    • Booking Fee: Required immediately to secure the date (Non-refundable).

    • Progress Payment: 50% of the total balance is due 1 month prior to the event date.

    • Final Balance: The remaining balance must be cleared in full by 7 days before the event date.

  • Late Payment: Failure to pay the balance by the due date may result in the cancellation of services or a delay in the delivery of final materials.

3. CANCELLATION & POSTPONEMENT POLICY

We understand that plans can change. Our policy regarding cancellations and date changes is as follows:

Change of Date (Postponement)

  • If you need to postpone your event, the Booking Fee may be transferred to a new date, subject to The Company’s availability.

  • New Rates: If the new date falls in a different calendar year or season, new rates may apply.

  • Unavailability: If The Company is not available for your new chosen date, the Booking Fee remains non-refundable.

Cancellation by Client

  • All Booking Fees are strictly non-refundable.

  • Cancellations made within 30 days of the event date will incur the full cost (100%) of the quoted package to cover lost business, reserved crew, and perishable resources.

4. FORCE MAJEURE / UNCONTROLLABLE EVENTS

No refunds will be issued for events affected by circumstances beyond our control. This includes, but is not limited to:

  • Disease / Pandemic outbreaks.

  • Extreme weather conditions.

  • Venue restrictions or closures.

  • Travel restrictions or border closures.

  • Government regulations or lockdowns.

  • Natural disasters.

  • Emergency situations.

  • Any other Force Majeure event. Client Acknowledgement: The Client understands these circumstances are outside of The Company’s control and accepts the risk.

5. PARTIAL SERVICE CHANGES

We allow flexibility, but major changes affect our planning and resource allocation.

  • Reduction of Services: If The Client reduces the scope of services (e.g., removing a photography session or décor item) after booking, no refunds will be issued for the removed services.

  • Add-Ons: Additional services requested after the initial booking will be charged separately.

  • Written Request: All changes to the service package must be requested in writing via email or WhatsApp.

6. PHOTOGRAPHY / VIDEOGRAPHY DELIVERY & ARTISTIC LICENSE

  • Creative Control: The Client trusts The Company’s professional judgment regarding angles, locations, and editing style.

  • No Refunds on Artistry: Refunds cannot be requested based on:

    • Artistic style or composition.

    • Colour grading preferences.

    • Specific photo selection (or omission of specific shots).

    • Editing direction.

    • Delivery time (unless there is an unreasonable delay beyond standard industry timelines).

  • Delivery Timeline: We strive to deliver the final edited photos and videos within 3 to 6 months from the event date, depending on the seasonal workload. Teasers (if applicable) are typically delivered within 14 days.

7. EVENT DAY CONDITIONS

The Company is not liable for compromised quality due to factors on the event day. Refunds will not be issued for:

  • Late Arrival: Delays caused by the Client or the makeup artist.

  • Venue Delays: Restrictions or delays caused by the venue management.

  • Guest Interruptions: Guests obstructing camera views or interfering with the crew.

  • Weather Issues: Rain, wind, or lighting conditions affecting outdoor events.

  • Ceremony Changes: Sudden changes to the timing or flow of rituals.

  • Unforeseen Adjustments: Any schedule changes made on the day.

  • Note: These are considered normal wedding variables and are the Client’s responsibility to manage.

8. COPYRIGHT & MODEL RELEASE

  • Copyright: The copyright of all photographs and videos remains with Shawn Studioss. The Client is granted a license for personal use (printing and sharing). Commercial use is prohibited without written consent.

  • Marketing Use: The Client grants The Company the right to use selected images and footage for marketing purposes, including website portfolios, social media (Instagram, Facebook, YouTube), and awards entries, unless a Non-Disclosure Agreement (NDA) is signed prior to the event (additional fees may apply for exclusivity).

9. DOUBLE BOOKING POLICY

In the rare event of an accidental administrative error resulting in a double booking:

  • Priority: The booking is honoured for the Client who paid the Booking Fee first.

  • Refund: The second booking client (who cannot be accommodated) will receive a full refund of their paid fee only if no alternative team from our company is available to cover the event.

10. LIABILITY & DAMAGES

  • Equipment Damage: If The Company’s equipment (cameras, lights, décor props) is damaged by The Client or their guests due to negligence or unruly behavior, The Client will be charged for the full cost of repair or replacement.

  • Catering & Decor: For Shawn’s Kitchen and Decor services, we are not liable for allergic reactions (unless dietary requirements were not met as agreed) or structural issues caused by venue limitations.

11. FINAL DECISION & JURISDICTION

  • Discretion: All refund and cancellation decisions are strictly based on this policy and are at the sole discretion of Shawn Studioss Management.

  • Governing Law: These terms are governed by the laws of Malaysia. Any disputes shall be resolved in the courts of Johor, Malaysia.

12. ACCEPTANCE

By making a payment (Booking Fee or Full Payment), The Client automatically agrees to the terms stated in this Refund & Cancellation Policy.
